La formulazione dell'art. 2043 c.c., come quella di ogni proposizione giuridica, sia pure non senza eccezioni, richiama un rapporto logico di condizionalità tra un fatto ed un valore: l'atto illecito doloso o colposo, quale antecedente assiologico, del possibile - in concorso con l'elemento dell'ingiustizia- rimedio risarcitorio, effetto giuridico o valore condizionato dal verificarsi di un fatto. Ed infatti, una indagine concernente i giudizi di responsabilità secondo il nostro diritto positivo consente di affermare che la risposta risarcitoria in alcuni casi prescinde dalla individuazione di un atto illecito, così come al verificarsi di questo non sempre trova applicazione una regola di responsabilità, confermandosi la necessità di una disamina che attribuisca nuovi spazi concettuali ed operativi alla categoria dell'atto illecito.

L'indagine, premessa la stretta correlazione esistente tra comunione e divisione, dedica ampio spazio, nella trattazione che precede l'esame delle singole previsioni normative in materia, alla natura giuridica della divisione, in particolare all'alternativa dichiaratività-costitutività, anche in ragione dell'orientamento giurisprudenziale, che ha attribuito alla divisione causa attributiva e distributiva, quale atto inter vivos assimilabile a quelli aventi natura traslativa. Le conseguenze sul piano applicativo sono rilevanti, specie in materia di pubblicità, producendo la trascrizione della divisione l'effetto di cui all'art. 2644 c.c. Sullo sfondo dell'indagine vi è tuttavia la consapevolezza del ridimensionato ruolo che oggi riveste il fenomeno successorio nella trasmissione della ricchezza, la quale avviene spesso mediante il ricorso a strumenti diversi dalla successione mortis causa, specie quando si tratta di patrimoni di rilevante valore. Aspetto questo che si riverbera inevitabilmente sulla conseguente attività di divisione dei beni caduti in successione.

Shapwick lies in the middle of Somerset, next to the important monastic centre of Glastonbury: the abbey owned the manor for 800 years from the 8th to the 16th century and its abbots and officials had a great influence on the lives of the peasants who lived there.
